1. AGREEMENT TO TERMS
By accessing the website Elyazia.com (the "Site") and/or purchasing goods from us, you engage in our "Service" and agree to be bound by the following terms and conditions ("Terms"). These Terms apply to all users of the site, including without limitation users who are browsers, vendors, customers, and merchants.
2. PRECIOUS METAL AUTHENTICITY & STANDARDS
ELYAZIA is a specialist boutique for solid precious metals.
- Composition: We warrant that every item sold is composed of Solid Precious Metals (10K, 14K, 18K, 22K, or 24K Gold; 925 Sterling Silver) throughout. We do not sell plated, filled, or vermeil products.
- Marking & Hallmarking: In accordance with the National Gold and Silver Stamping Act (USA) and international standards, all items bear a fineness mark (e.g., "750" for 18K) and the ELYAZIA® Responsibility Mark.
- UK Compliance: For orders delivered within the United Kingdom, gold items exceeding 1.0g and silver exceeding 7.78g are hallmarked in accordance with the UK Hallmarking Act 1973.
3. PRICING AND MARKET VOLATILITY
Market-Linked Pricing: Precious metals are commodities subject to global market fluctuations. ELYAZIA reserves the right to update pricing in real-time.
Order Confirmation: An order is only considered accepted once you receive an "Order Shipped" notification. In the event of a significant market spike or a technical pricing error, ELYAZIA reserves the right to cancel and refund an order prior to dispatch.
4. PAYMENT AND ANTI-MONEY LAUNDERING (AML)
Secure Transactions: All payments are processed via 256-bit encrypted gateways (Stripe/PayPal/Wise).
High-Value Verification: To comply with the UK Money Laundering Regulations and international KYC (Know Your Customer) standards, any transaction exceeding $2,500 USD (or local equivalent) may be subject to a request for government-issued identification before the order is released for shipment.
5. RIGHT TO CANCEL (2026 "WITHDRAWAL BUTTON" RULES)
Under the UK Consumer Contracts Regulations (Amended 2026):
- Cancellation Period: You have the right to cancel your order from the moment you place it until 14 days after you receive the goods.
- Withdrawal Procedure: You may use the "Withdrawal/Cancellation" button located in your Customer Account portal or email legal@elyazia.com with your order number.
- Exclusions: This right does not apply to items that have been personalized, engraved, or to earrings/body jewelry where the hygiene seal has been broken.
6. LIMITATION OF LIABILITY & PRODUCT CARE
Material Properties: 24K Gold is 99.9% pure and is naturally malleable (soft). ELYAZIA is not liable for structural damage, bending, or scratches resulting from standard wear and tear of high-purity gold.
Usage: Jewelry should not be exposed to harsh chemicals, chlorine, or abrasive surfaces. Damage caused by improper care is the sole responsibility of the customer.
7. INTELLECTUAL PROPERTY
The name ELYAZIA, our logos, custom designs, and website content are the intellectual property of [Your UK Company Name] Ltd. Any unauthorized commercial use, reproduction, or "scraping" of our digital assets is strictly prohibited and protected under the UK Intellectual Property Office (UKIPO).
8. IMPORT AND CUSTOMS (INTERNATIONAL)
For orders shipped outside the United Kingdom (specifically to the UAE and USA):
- Importer of Record: The customer is the legal Importer of Record and must comply with all local laws and regulations.
- Duties and Taxes: Any import duties, VAT, or brokerage fees levied by the destination country are the sole responsibility of the customer. ELYAZIA cannot predict or control these government-imposed charges.
9. DISPUTE RESOLUTION
Any dispute arising under these Terms shall be governed by the laws of England and Wales. Both parties agree to attempt mediation before initiating formal legal proceedings.
